Tax Attorney for Innocent Spouse Relief

Your spouse's tax problem became your tax problem. Innocent spouse relief can separate your liability, but it requires legal analysis.

If you filed a joint return with your spouse and the IRS is now holding you liable for tax debt caused by your spouse's understatement of income or fraudulent deductions, innocent spouse relief under IRC section 6015 may separate your liability.

There are three forms of relief: traditional innocent spouse relief (you didn't know about the understatement), separation of liability (you're divorced or separated), and equitable relief (a catch-all when the other two don't apply but it would be unfair to hold you liable).

Why an Attorney

Innocent spouse cases involve legal analysis of knowledge, intent, and equity. The IRS will analyze your financial situation during the years in question, what you knew or should have known, and whether you benefited from the understatement. An attorney presents these factors in the light most favorable to your case and appeals if the initial request is denied.

If your spouse's tax problem has become yours, let's talk.
